KRS 281.630 authorizes the Department of Vehicle Regulation to establish requirements for a transportation network company to apply for authority to operate in Kentucky. KAR Title 601, Chapter 001, Regulation 113, Section 3 provides the specific insurance regulations these companies must follow:

“Section 3. Demonstration of Financial Responsibility and Insurance. (1) A TNC shall maintain primary automobile insurance that: (a) Recognizes that a driver is a TNC driver or using a vehicle to transport passengers for compensation; and (b) Provides insurance coverage for a TNC driver who is: 1. Logged on to the TNCs mobile application; or 2. Engaged in a prearranged ride. (2) The following pre-trip acceptance liability policy insurance coverage requirements shall apply if a TNC driver is logged on to the TNC’s mobile application and available to receive transportation requests but not engaged in a prearranged ride: (a) Primary automobile liability insurance in the minimum amounts required by KRS 281.655(12); (b) Basic reparation benefits in accordance with KRS 304.39-020; (c) Uninsured vehicle coverage in accordance with KRS 304.20-020; and (d) Underinsured vehicle coverage in accordance with KRS 304.39-320. (3) The pre-trip acceptance liability policy insurance coverage requirements of KRS 281.655(12) shall be satisfied by one (1) of the following: (a) Automobile insurance maintained by the TNC; (b) Automobile insurance maintained by the TNC driver.”

This means that TNCs must maintain insurance that recognizes the driver as a TNC driver or when using a vehicle for passenger transport for compensation and provides specific coverage levels when the TNC driver is logged onto the TNC’s mobile application or engaged in a prearranged ride. For drivers logged onto the TNC’s mobile application but not engaged in a prearranged ride, the insurance must cover primary automobile liability insurance in minimum amounts as required by KRS 281.655(12) and basic reparation benefits, uninsured vehicle coverage, and underinsured vehicle coverage as per relevant KRS statutes. While a TNC driver is engaged in a prearranged ride, the required insurance includes primary automobile liability insurance with minimum amounts specified by KRS 281.655(4).

  • From the Moment a Ride is Accepted Until the Passenger is Dropped Off: Uber’s policy escalates to provide $1 million in liability coverage, significantly higher than most personal auto insurance limits. This comprehensive coverage includes third-party liability, uninsured/underinsured motorist coverage, and contingent comprehensive and collision insurance for the driver’s vehicle, subject to a deductible.
  • Driver’s Insurance: It’s important to note that Uber expects drivers to maintain their auto insurance policy according to Kentucky’s minimum requirements.
