Our Lexington Car Accident Team

Insurance requests can arrive while you are still treating after a Lexington car accident. The other driver’s adjuster may want a recorded statement or a medical authorization before your doctors know the full cost of your care. Your legal team handles those requests while you focus on treatment.

You don’t have to do this alone. When an accident turns your life upside down, we’re here to pick you up. Insurance companies will try to minimize your pain. We don’t let that happen. Our Lexington personal injury attorneys are led by Jon Hollan, Managing Partner, and every case gets a dedicated three-person team: a top-rated attorney, an experienced case manager, and a skilled legal assistant. With our Bigger Share Guarantee®, you always get more. You pay $0 out-of-pocket forever, and most cases qualify in under 10 minutes through a free case review.

Our Kentucky car accident lawyers handle cases statewide. An accident with a tractor-trailer or other commercial truck goes to our Lexington truck accident lawyer team. Those cases may involve carrier records required by federal law, including the driver’s qualification file.

Insurance Requests After a Lexington Car Accident

After an accident, insurance companies are about protecting their bottom line. We’re about protecting you. The other driver’s adjuster may ask you for a recorded statement, a signed medical authorization, and a quick settlement before your treatment is finished.

An early settlement offer may arrive before the full cost of treatment is known. In Humana, Inc. v. Blose, the Kentucky Supreme Court explains that a valid release can bar further recovery from parties it covers. KRS 411.182(4) says releasing one liable person does not automatically discharge other liable people.

When we represent you, every insurer is notified, and those requests go to your legal team instead of to you. Your team reviews the recorded statement request and the scope of any medical authorization.

Fayette County Car Accident Numbers

In 2023, Northeast New Circle Road had Lexington’s highest corridor count of fatal and serious-injury accidents and carried more than 40,000 vehicles a day. From 2017–2021, an estimated 27 fatal accidents happened in and around that corridor. During the same five years, 168 people were killed in motor vehicle accidents across Lexington-Fayette County.

Northeast New Circle Road is a signalized, four-lane principal arterial with long spacing between signals and crosswalks and direct driveway access to frontage roads. At a signal or driveway, the investigation can compare signal timing, each car’s turning movement and any video that recorded the accident.

Fayette County had 12,188 accidents in 2024. Of those, 1,745 were nonfatal-injury accidents and 34 were fatal, with 2,423 people injured and 37 killed. The county also had 393 alcohol-related accidents and 77 accidents with a driver under the influence of drugs.

Lexington Car Accident Camera Footage

Sam Aguiar Injury Lawyers has direct access to DOT and TRIMARC traffic camera archives that reach back six months. In Fayette County, the Kentucky Transportation Cabinet’s traffic cameras sit along I-75, from the Clays Ferry Bridge north through both splits with I-64, at interchanges including Newtown Pike, Man O War Boulevard, Winchester Road and Athens-Boonesboro Road.

We look for a recording by searching the DOT camera database for the time and camera that match the accident. That six-month access does not mean a camera recorded every accident. The city’s public traffic-camera streams are not recorded, so a live view on that map is not an archived video.

Who Pays Medical Bills After a Lexington Car Accident?

When basic personal injury protection (“PIP”) applies, the insurance on the vehicle you occupied pays first. For a pedestrian, it is the policy on the vehicle that struck the person, under KRS 304.39-050. Basic benefits cover up to $10,000 per person for one accident under KRS 304.39-020, subject to eligibility and covered loss.

If that insurer does not pay within 30 days after receiving reasonable evidence of both the loss and its amount, KRS 304.39-050 allows payment under another basic PIP policy that covers the injured person. Medical costs beyond the $10,000 in basic PIP benefits may be recoverable from the at-fault driver, depending on liability and available coverage.

Coverage Sources

Kentucky’s minimum liability coverage is $25,000 per person and $50,000 per accident for injuries, plus $25,000 for property damage, or a $60,000 combined single limit, under KRS 304.39-110. A serious injury can cost more than a $25,000 policy pays, so the case also looks at your own coverage.

Under KRS 304.20-020, a Kentucky auto policy includes uninsured motorist coverage unless the named insured rejected it in writing. It can pay covered damages when the at-fault driver has no insurance and the injured person qualifies as an insured under the policy.

Underinsured motorist coverage can pay uncompensated damages above the at-fault driver’s liability limits. Under KRS 304.39-320, insurers must make it available on request. The case checks whether a policy covers you and what its terms and limits provide; coverage is not automatic.

An impaired-driver case can add a source of payment. Under KRS 413.241, a licensed bar or restaurant may share responsibility for an adult patron’s off-premises accident if a reasonable person in the same or similar circumstances should have known the patron was already intoxicated when served. The intoxicated person remains primarily liable. That service history can make the accident a Lexington dram shop case as well.

Lexington Car Accident Case Stages

Your Lexington car accident team can take the case from the first review through settlement or, when needed, a lawsuit.

1

Free Case Review

Most cases qualify in under 10 minutes. You describe the accident, your injuries, and the insurance involved, and the firm tells you whether it can take the case.

2

Insurance Notice

The firm notifies every insurer involved that you are represented. From then on, adjuster calls, letters, and requests go to your legal team.

3

Treatment Records

While you treat, your team collects the medical records and bills that document each injury and what it cost. Your doctors decide your care.

4

Settlement Demand

The firm sends the insurer a demand built on those records, your lost wages, and your pain and suffering.

5

Lawsuit

If the insurer will not pay what the case is worth, the firm files suit. Against a Kentucky-resident defendant, KRS 452.460 allows filing where the defendant lives or where the injury happened. A Lexington accident can therefore be filed in Fayette County. The fee does not increase.

Frequently Asked Questions

1Is Sam Aguiar Injury Lawyers a Lexington Law Firm?

Yes. Sam Aguiar Injury Lawyers is a Lexington personal injury firm. Jon Hollan, Managing Partner, leads the Lexington team, which represents people injured across Fayette County and Central Kentucky.

2How Much Does a Lexington Car Accident Lawyer Cost?

Nothing out of pocket. Sam Aguiar Injury Lawyers works on a contingency fee, with no upfront costs, no retainers, and no fees unless the firm wins the case. The fee percentage never increases if the case goes to trial. Under the Bigger Share Guarantee®, the client always walks away with more money than the firm after medical bills, liens, and case expenses are paid, and if the client’s share would ever be less than the legal fee, the firm cuts its fee.

3What If the Driver Who Caused My Car Accident Had No Insurance?

Uninsured motorist coverage can pay when the injured person qualifies as an insured under a policy. Under KRS 304.20-020, a Kentucky auto policy includes that coverage unless the named insured rejected it in writing.

4Can a Lawyer Get Traffic Camera Video of My Lexington Car Accident?

Yes, when a camera recorded it. Sam Aguiar Injury Lawyers has direct access to DOT and TRIMARC traffic camera archives that reach back six months. In Fayette County, the state’s traffic cameras sit along I-75, including both splits with I-64. Availability depends on the camera, time and location; the city’s public camera streams are not recorded.

5Does a Car Accident Case Have to Go to Court?

No. A case can resolve with the insurance company without a lawsuit. When a lawsuit is needed against a Kentucky-resident defendant, KRS 452.460 allows filing in the defendant’s home county or the county where the injury happened. The firm’s fee does not increase.

6Who Works on a Lexington Car Accident Case?

A dedicated three-person team: a top-rated attorney, an experienced case manager, and a skilled legal assistant. Clients get biweekly updates and 24/7 response to calls and texts.

7Does the Firm Offer Spanish-Language Service in Lexington?

Yes. Hablamos español. The Lexington team represents Spanish-speaking clients in car accident cases.

8Is a Car Wreck Case Different From an Auto Accident Case?

No. Car wreck, car crash, auto accident and automobile collision describe the same kind of motor vehicle case. The facts and applicable insurance determine coverage, rather than the name used. Under KRS 304.39-050, basic PIP generally comes first from the occupied vehicle’s policy, or the striking vehicle’s policy for a pedestrian. Sam Aguiar Injury Lawyers handles Lexington car accident cases on I-75, I-64, New Circle Road and other local roads.
