Why Hire a Pikeville Car Accident Lawyer?
Hiring us puts a top-rated attorney, an experienced case manager, and a skilled legal assistant on your case, and part of their job is finding every insurance policy that can pay. Accidents are life-changing, and who you hire is one of the most important decisions you can make.
Kentucky’s minimum liability insurance under KRS 304.39-110 is $25,000 for one person’s injuries and $50,000 for everyone hurt in the same accident. A serious injury can cost more than that.
Under KRS 304.20-020, your own auto policy includes uninsured motorist coverage unless a named insured rejected it in writing. That coverage applies when the driver who hit you had no insurance.
Underinsured motorist coverage pays when the at-fault driver’s limits are too low. KRS 304.39-320 requires every insurer to make it available on request.

Who Pays Medical Bills After a Car Accident in Kentucky?
PIP, Kentucky’s no-fault coverage, pays first. Under KRS 304.39-020, it covers up to $10,000 per person for medical bills, lost wages, and the cost of replacing household work you can’t do after one accident.
KRS 304.39-050 assigns PIP to the insurance on the vehicle you were riding in. If you were on foot, the insurance on the vehicle that struck you pays.
The insurer has 30 days after it receives reasonable proof of the loss. After that, KRS 304.39-210 treats the payment as overdue and adds interest at 12% a year, or 18% when the delay had no reasonable foundation.

Coal Truck Accidents in Pike County
Coal moves through Pike County by truck. The Kentucky Transportation Cabinet’s 2025 coal ton-miles report lists Pike County as a coal-producing county, with 2,309,958 ton-miles hauled by truck.
That hauling leaves records. Coal transporters report their routes and tonnage to the Transportation Cabinet, and the cabinet keeps its extended-weight coal haul road system as a separate designation that the coal-haul report does not show. After an accident with a loaded truck, those filings and the hauler’s load records show what the truck carried and the route it reported.
Those public filings are one source in a truck accident case. The trucking company’s own records are another.
- 1Quick offers arrive before your doctors know how long treatment will last.
- 2Recorded statements are compared word for word with your medical records.
- 3A gap between appointments becomes an argument that you weren’t badly hurt.
- 4Broad medical authorizations open years of unrelated health history.
- 5Social media photos are used to question your injuries.
- 6Ongoing pain gets labeled a minor soft-tissue injury and paid that way.
How Adjusters Pay Pikeville Accident Victims Less
Kentucky divides fault by percentage. Under KRS 411.182, a jury gives each party a share of the fault and the award follows those shares, so every point an adjuster moves onto you comes off what your claim is worth.
The second argument is the threshold. For most Kentucky drivers, KRS 304.39-060 allows a claim for pain and suffering only after medical expenses pass $1,000, or when the injury includes a broken bone, a permanent injury, permanent disfigurement, or death. A gap in treatment or a soft-tissue label can be used to argue a claim never crossed that line.
Then there is the clock. KRS 304.39-230 gives you two years from the injury or from the last PIP payment, whichever is later, to file suit. Negotiating with an adjuster does not pause it.
Compensation You Can Recover After a Pikeville Car Accident
Economic damages repay money the accident cost you; non-economic damages cover pain and the parts of life it took away. PIP pays only economic loss under KRS 304.39-020, so pain and suffering is part of the case against the driver who caused the accident.

You Only Have One Shot
With the Insurance Company
An injury settlement release is permanent. Once you sign it, the case is closed, even if you need surgery or months of therapy later.
Under KRS 411.182(4), releasing one person who is liable does not discharge anyone else liable for the same claim unless the release says so.
Insurance companies will try to lowball your case. We don’t let that happen.
Pikeville Flood Relief
When floods hit Eastern Kentucky in February 2025, our team loaded vehicles with supplies and drove east. Some of the people who made the trip have ties to the region. They delivered more than 7,000 pounds of food, water, clothing, blankets, and medical supplies to the Pikeville area.
The flood relief trip was part of Sam Cares, our community program. Through it, Sam Aguiar Injury Lawyers has donated over $6,000,000 to Kentucky charities, civic organizations, and families in need.

Frequently Asked Questions
1Can health insurance pay car accident bills in Kentucky?
Yes. Health insurance, Medicaid, or Medicare may pay accident bills, and under KRS 304.39-241 the injured person can direct PIP in writing to reimburse those plans for related bills they already paid. The same statute lets the insured direct how PIP is split among the different kinds of loss.
2How much does PIP pay for lost wages in Kentucky?
On policies issued or renewed on or after July 15, 2026, PIP pays lost wages up to $500 a week under KRS 304.39-130. Those payments count toward the $10,000 per-person limit in KRS 304.39-020.
3What if the driver who caused a Pikeville car accident has no insurance?
The injured person can turn to uninsured motorist coverage. Under KRS 304.20-020, Kentucky auto policies include it unless a named insured rejected it in writing. When the at-fault driver has insurance but too little, underinsured motorist coverage, which insurers must offer on request under KRS 304.39-320, can pay the difference up to its limits.
4Should someone accept the first settlement offer after a car accident?
Not before the full cost of medical care is known. An injury settlement release is permanent: once it is signed, the case is closed, even if more treatment is needed later.
5Does a Pikeville car accident case have to go to court?
Not always. A case can resolve with the insurance company before a lawsuit is filed, or it can go to court. When a case does go to court, the firm’s flat contingency fee never increases.
6How much does it cost to hire Sam Aguiar Injury Lawyers?
Clients pay no upfront costs or retainers, and no fees unless the firm wins the case. Under the Bigger Share Guarantee®, the client always walks away with more than the firm, and the firm cuts its fee if the client’s share would be smaller.
7Who keeps records of coal truck routes in Pike County?
Coal transporters report their routes and tonnage on Kentucky public roads to the Kentucky Transportation Cabinet, which publishes an annual coal haul highway system report. The 2025 report lists Pike County as a coal-producing county.
